The purpose of this Privacy Policy is to inform the User of how FUSILY collects, uses and shares personal data relating, directly or indirectly, to an identified natural person (hereinafter "Data") in accordance with the various regulations in force, and in particular:

FUSILY also wishes to draw the User's attention to the fact that any other user of the mobile application may themselves become a data controller if they process the data you communicate and/or exchange in the course of using the mobile application for their own purposes. As such, each user is solely responsible for complying with their obligations under personal data regulations with respect to other users.

ARTICLE 2 - PERSONAL DATA COLLECTED

When making its mobile application and website available, FUSILY collects various Data from the User, enabling their identification for various purposes including commercial, prospecting or statistical analysis purposes.

The information provided by the User includes the following types of data:

  • Identification data – when you fill in a form on the application or the website.
  • Transaction data – when you make a purchase through the application or the website.
  • Publicly available data – when you voluntarily share information by contacting FUSILY, on social networks, in article comments or on blogs and forums.

ARTICLE 3 - LEGAL BASES AND PURPOSES OF PROCESSING

FUSILY collects and processes the User's Data in the context of making its Site available for various purposes.

Data is only collected on the basis of one or more legal bases determined by the provisions of the GDPR.

ARTICLE 4 - DATA RECIPIENTS

As data controller, the Data we process may be disclosed to:

  • FUSILY and members of its team;
  • Other users of the mobile application with whom you may interact during its use.

In addition, FUSILY may transmit part of the collected Data, where necessary, to certain of its partners considered as processors under the GDPR, solely for the purposes for which the Data was collected. The disclosure of such Data is strictly limited to the Data necessary for the identified processing operations.

Finally, FUSILY informs the User that the collected Data may be transmitted to any administration, competent authority and/or court in application of legal, regulatory or judicial obligations incumbent upon it.

ARTICLE 5 - DATA RETENTION PERIODS

FUSILY only processes the Data collected from the User for the period strictly necessary to achieve the purposes detailed in Article 3 of this Policy. Once the period has expired, the Data is automatically deleted by FUSILY.

In this regard, the various data retention periods implemented by FUSILY are listed in the table below.

Content creation and contributionThe content you publish (recipes, photos, videos, comments) is retained for as long as your account is active or until you request its deletion. In the event of account deletion, your content is deleted or anonymised, unless the law requires longer retention.
NewsletterData used for sending newsletters is retained until you unsubscribe from the list or for a maximum of 3 years after your last contact with FUSILY.
Contacting FUSILYData is retained for the period necessary to respond to the User's request or for a maximum period of six (6) months from the date of the User's enquiry.
Data transmitted by cookiesData collected by cookies is retained for a maximum period of thirteen (13) months or a shorter period depending on the purpose of the cookies.

FUSILY deletes the User's Data as soon as the purpose for which it was collected has been fulfilled or the retention period for the relevant purpose has expired.

Nevertheless, certain Data may be archived beyond the specified periods for the purposes of investigating, establishing and prosecuting potential civil or criminal offences, solely to enable, where necessary, the provision of Data to the judicial authority.

Archiving means that the Data will no longer be accessible online but will be extracted and stored on a separate and secure medium.

The User also has the option of obtaining the deletion of their Data at any time by requesting the deletion of their Data as described in Article 6 below.

ARTICLE 6 - RIGHTS OF DATA SUBJECTS

In accordance with Articles 15 et seq. of the GDPR, each User has rights regarding their Data which they may exercise with FUSILY in connection with the collection and processing it carries out.

The User may exercise the following rights:

  • Right of access to their Data you have the right to be informed of and to access the Data that has been collected about you.
  • Right to rectification of inaccurate Data you have the right to obtain the correction of Data concerning you when it is inaccurate.
  • Right to erasure you have the right, in certain cases, to obtain the erasure of your Data without undue delay.
  • Right to restriction of processing of their Data you have the right, in certain cases, to request that your Data be temporarily no longer processed by FUSILY.
  • Right to data portability you have the right to receive the Data you have provided to FUSILY in a structured, commonly used and machine-readable format, for personal use or for transmission to a third party of your choice.
  • Right to object regarding their Data you have the right to object, at any time, to the processing of your Data when the processing is based on our legitimate interest or for direct marketing purposes.
  • Right to withdraw consent regarding the processing of their Data you may withdraw your consent at any time when the processing is based on obtaining your consent.

The User may exercise one or more of the above-mentioned rights by sending a reasoned written request to FUSILY at the following email address: rgpd@fusily.com.

FUSILY reserves the right to request a valid proof of identity.

Once the request has been received by FUSILY, it will endeavour to provide a satisfactory response to the User within one (1) month or, in the case of a complex request, within a reasonable period after prior notification to the User.

FUSILY reserves the right to request additional information or clarification from the User regarding their request in order to respond as accurately as possible, or to refuse to grant the request on legitimate grounds which will be communicated to the User.

The request will be processed by FUSILY, which will inform all of its partners likely to have processed the User's Data with their consent, except where disproportionate measures would be required.

ARTICLE 7 - RIGHT TO LODGE A COMPLAINT WITH THE CNIL

If the User considers that the response provided by FUSILY is unsatisfactory or that their rights have been infringed, they have the option of lodging a complaint with the CNIL to assert their rights, without prejudice to any other administrative or legal remedy. This request can be made via the following link: https://www.cnil.fr/fr/plaintes.

The CNIL will inform the User of the progress and outcome of their complaint, including the possibility of a legal remedy.

ARTICLE 8 - DATA TRANSFERS

As a general rule, the Data you transmit to FUSILY is stored within the territory of the European Union.

Nevertheless, certain partners of FUSILY, who may process User Data, may be located in a territory outside the European Union or the European Economic Area.

Data transmitted to these partners is strictly limited to that necessary for the processing of requests for which the purposes have been defined in Article 3 above.

Where Data is transferred outside the European Union, FUSILY takes all necessary measures with its partners to ensure adequate protection of the transferred Data, in accordance with applicable regulations.

No Data collected from the User by FUSILY shall be sold, exchanged or licensed to third parties other than its partners to whom the User has previously consented to the transmission of their data.

ARTICLE 9 - INFORMATION SECURITY

In order to ensure optimal protection of the Data collected from Users, FUSILY has implemented various technical and organisational measures to guarantee the integrity, security and confidentiality of Data in accordance with the requirements set out in Article 32 of the GDPR.

The measures implemented by FUSILY aim to prevent any loss, destruction, alteration, misuse, modification, disclosure, deletion and/or unauthorised access to User Data during the use of the mobile application or the website. Access to Data is strictly limited to persons who genuinely need access for professional reasons.

However, the User acknowledges that despite the measures taken by FUSILY, data security cannot be guaranteed 100% and that a risk of interception always remains possible.

ARTICLE 10 - COOKIES

A cookie is a small text file that a website, application or any other online platform stores on the User's device (computer, tablet, smartphone or other similar device) when they access content, for the purpose of retaining information about the User's browsing, usage or preferences.

Certain cookies are strictly necessary for the proper use of the Site and do not require any prior consent from the User.

Other cookies, considered optional, may require the User's express and prior consent before being placed on the device used. These include the following cookies:

  • Statistical cookies These cookies are used to obtain traffic statistics and audience measurements for the mobile application or the website in order to detect navigation issues and optimise its usability, navigation and content.
  • Targeted advertising cookies These cookies enable advertising partners to present the User with relevant advertisements that match their interests.

ARTICLE 11 - UPDATES TO THE PRIVACY POLICY

FUSILY informs the User that this Privacy Policy made available on the mobile application and the website may be updated at any time.

In the event of a substantial modification, the User will be informed by FUSILY by email.
